Please see below some information about your rights and protections.<\/p>\n<h1>Patient Rights &amp; Protections<\/h1>\n<p><strong>Your Rights and Protections Against Surprise Medical Bills<\/strong><\/p>\n<h2><span style=\"color: #666666; font-size: 14px;\">When you get emergency care or are treated by an out-of-network provider at an in-network hospital or ambulatory surgical center, you are protected from balance billing. In these cases, you shouldn\u2019t be charged more than your plan\u2019s copayments, coinsurance and\/or deductible.<\/span><\/h2>\n<h2><span style=\"color: #666666; font-size: 14px;\">When you see a doctor or other health care provider, you may owe certain<\/span><a style=\"font-size: 14px;\" href=\"https:\/\/www.healthcare.gov\/glossary\/out-of-pocket-costs\/\"> out-of-pocket costs<\/a><span style=\"color: #666666; font-size: 14px;\">,\u00a0 like a<\/span><a style=\"font-size: 14px;\" href=\"https:\/\/www.healthcare.gov\/glossary\/co-payment\/\"> copayment<\/a><span style=\"color: #666666; font-size: 14px;\">,<\/span><a style=\"font-size: 14px;\" href=\"https:\/\/www.healthcare.gov\/glossary\/co-insurance\/\"> coinsurance<\/a><span style=\"color: #666666; font-size: 14px;\">, or<\/span><a style=\"font-size: 14px;\" href=\"https:\/\/www.healthcare.gov\/glossary\/deductible\/\"> deductible<\/a><span style=\"color: #666666; font-size: 14px;\">. You may have additional costs or have to pay the entire bill if you see a provider or visit a health care facility that isn\u2019t in your health plan\u2019s network.<\/span><\/h2>\n<h2>What is \u201cbalance billing\u201d (sometimes called \u201csurprise billing\u201d)?<\/h2>\n<p>\u201cOut-of-network\u201d means providers and facilities that haven\u2019t signed a contract with your health\u00a0 plan to provide services. Out-of-network providers may be allowed to bill you for the difference\u00a0 between what your plan pays and the full amount charged for a service. This is called \u201c<strong>balance billing<\/strong>.\u201d This amount is likely more than in-network costs for the same service and might not count toward your plan\u2019s deductible or annual out-of-pocket limit.<\/p>\n<p>\u201cSurprise billing\u201d is an unexpected balance bill. This can happen when you can\u2019t control who is involved in your care\u2014like when you have an emergency or when you schedule a visit at an in- network facility but are unexpectedly treated by an out-of-network provider. Surprise medical bills could cost thousands of dollars depending on the procedure or service.<\/p>\n<h2>You\u2019re protected from balance billing for:<\/h2>\n<h3>Emergency services<\/h3>\n<p>If you have an emergency medical condition and get emergency services from an out-of-network provider or hospital, the most they can bill you is your plan\u2019s in-network cost-sharing amount (such as copayments, coinsurance, and deductibles). You <strong>can\u2019t <\/strong>be balance billed for these emergency services. This includes services you may get after you\u2019re in a stable condition, unless you give written consent and give up your protections not to be balanced billed for these\u00a0 post-stabilization services.\u00a0 If your insurance ID card says \u201cfully insured coverage,\u201d you <strong>can\u2019t<\/strong> give written consent and give up your protections not to be balance billed for post-stabilization services.<\/p>\n<h3>Certain services at an in-network hospital or ambulatory surgical center<\/h3>\n<p>When you get services from an in-network hospital or ambulatory surgical center, certain providers there may be out-of-network. In these cases, the most those providers can bill you is \u00a0 \u00a0 \u00a0 your plan\u2019s in-network cost-sharing amount. This applies to emergency medicine, anesthesia, pathology, radiology, laboratory, neonatology, assistant surgeon, hospitalist, and intensivist services. These providers <strong>can\u2019t <\/strong>balance bill you and may <strong>not <\/strong>ask you to give up your protections not to be balance billed.<\/p>\n<p>If you get other types of services at these in-network facilities, out-of-network providers <strong>can\u2019t<\/strong><\/p>\n<p>balance bill you, unless you give written consent and give up your protections. If your insurance ID card says \u201cfully insured coverage,\u201d you <strong>can\u2019t<\/strong> give up your protections for these other services if they are a surprise bill. Surprise bills are when you\u2019re at an in-network hospital or ambulatory surgical facility and a participating doctor was not available, a non-participating doctor provided services without your knowledge, or unforeseen medical services were provided.<\/p>\n<h2>Services referred by your in-network doctor<\/h2>\n<p>If your insurance ID card says \u201cfully insured coverage,\u201d surprise bills include when your in-network doctor refers you to an out-of-network provider without your consent (including lab and pathology services). These providers <strong>can\u2019t <\/strong>balance bill you and may <strong>not <\/strong>ask you to give up your protections not to be balance billed.<\/p>\n<p>You may need to sign a form (available on the Department of Financial Services\u2019<a href=\"http:\/\/www.dfs.ny.gov\/\"> website<\/a>) for the full balance billing protection to apply.<\/p>\n<p><strong>You\u2019re never required to give up your protections from balance billing. You also aren\u2019t required to get out-of-network care. You can choose a provider or facility in your plan\u2019s network.<\/strong><\/p>\n<h2>When balance billing isn\u2019t allowed, you also have these protections:<\/h2>\n<ul>\n<li>You\u2019re only responsible for paying your share of the cost (like the copayments, coinsurance, \u00a0 and deductibles that you would pay if the provider or facility was in-network). Your health plan will pay any additional costs to out-of-network providers and facilities directly.<\/li>\n<li>Generally, your health plan must:\n<ul>\n<li>Cover emergency services without requiring you to get approval for services in advance (also known as \u201cprior authorization\u201d).<\/li>\n<li>Cover emergency services by out-of-network providers.<\/li>\n<li>Base what you owe the provider or facility (cost-sharing) on what it would pay an \u00a0 \u00a0 in-network provider or facility and show that amount in your explanation of benefits.<\/li>\n<li>Count any amount you pay for emergency services or out-of-network services \u00a0 toward your in-network deductible and out-of-pocket limit.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>If you think you\u2019ve been wrongly billed and your coverage is subject to New York law <\/strong>(\u201cfully insured coverage\u201d), contact the New York State Department of Financial Services at (800) 342-3736 or <a href=\"mailto:surprisemedicalbills@dfs.ny.gov\">surprisemedicalbills@dfs.ny.gov<\/a>.
